Repealing 40.2

December 5, 2022

Dr. Fredrykka Rinaldi, AMA President

Dear Members:

Today government has tabled legislation to repeal Section 40.2 of the Alberta Health Care Insurance Act. This regulation enabled termination of the AMA agreement and its repeal was a commitment by government under the new agreement. Here is the news release.

We will meet our corresponding commitment to withdraw the AMA lawsuit as soon as Bill 4 has passed through the Legislative Assembly and has been formally proclaimed into law. That date is currently unknown.

You are always welcome to share your thoughts with me. You can email me via president@albertadoctors.org. You can also comment on this letter on the AMA website.

Regards,

fred Rinaldi, MD, CCFP, FCFP, LLB, MBA, MPA(HSA), BCom
President, Alberta Medical Association

Perhaps we should not withdraw the lawsuit until after the next election. This premier is not trustworthy and has basically said that with an order in council the AB government will enforce its views on federal legislation-showing just how willing the UCP is to use such heavy handed tactics to support their flawed ideologies. And yet the Emergencies Act was enforced with far more consideration. Do not trust this woman she will destroy EVERYTHING the AMA has fought for since the last order in council tore up the last agreement.

Bad move as we are defacto agreeing with what they did to destroy community practice and ignoring the tremendous infrastructure we as physician entrepreneurs provide to our health care system with no guarantees as to our longevity. The only winners in the whole process are the government and our own Professional body, the AMA, which otherwise would serve us no purpose as they sold us down the river. We represent the most powerful lobby group in the Country as we provide care to all citizens including politicians but are not valued by the Government or our own Association. We are all Slaves to the Canada Health Act and hence provincial governments. Most of us thought slavery had been proven to be a bad thing.
